1. THE INFORMATION WE COLLECT

User-provided Information: When you create an account or make a purchase through the Theology Together Service, you may provide personally identifiable information such as your email address and payment information. The Theology Together Service is hosted on the Kajabi platform, and certain information may be collected or processed by Kajabi in connection with account creation, payment processing, and platform functionality. For information about Kajabi’s data practices, please refer to Kajabi’s privacy policy. Theology Together has intentionally minimized the data fields required at checkout. We do not require your name at checkout; however, after account creation, you may voluntarily add or update a display name and profile photo through your account settings. Do not upload names and photos of anyone under the age of 18. Doing so may result in immediate account termination.

“Cookies” Information: The Theology Together Service is hosted on the Kajabi platform, which uses cookies and similar technologies to operate the service. Theology Together does not independently deploy cookies beyond those used by the Kajabi platform. For details on Kajabi’s cookie practices, please refer to Kajabi’s cookie policy. Theology Together does not enable optional pixel tracking (such as Meta or analytics pixels) and does not use cookies or tracking technologies to collect personal information from children. Where required by law, a cookie consent mechanism will be presented to allow you to accept, reject, or manage cookie categories.

“Automatically Collected” Information: When you access the Theology Together Service or open one of our HTML emails, Theology Together or Kajabi may automatically collect certain information from your system using tracking technologies. This information may include your Internet Protocol address, a unique device or user ID, the version of software installed, system type, the content and pages that you access on the Theology Together Service, and the dates and times that you visit the Theology Together Service. Because the Theology Together Service is hosted on Kajabi, some automatically collected information may be collected or processed by Kajabi subject to Kajabi’s privacy policy.

Third Party Web Beacons: Theology Together does not currently enable third-party advertising pixels or web beacons. The Kajabi platform may use its own analytics tools, subject to Kajabi’s privacy policy.

Information from Other Sources:  Theology Together may receive limited information from payment processors or the Kajabi platform in connection with transactions, account administration, or platform functionality. Any such information will be handled in accordance with this Privacy Policy and applicable law.

2. THE WAY WE USE INFORMATION

Theology Together uses the information that you provide or that we collect to operate, maintain, enhance, and provide the features and functionality of the Theology Together Service, including delivering educational video content, administering adult-held accounts, processing purchases, supporting auto-graded quizzes, communicating with account holders, and maintaining platform security and legal compliance.

We will use your email address and other provided contact information, without further consent, for administrative communications such as notifying you of major Theology Together Service updates, processing or supporting purchases, addressing account or security matters, and responding to questions or privacy concerns. Theology Together uses the information that you provide or that we collect to understand usage trends and preferences, improve the way the Theology Together Service works and looks, and create new features and functionality.

Theology Together may use “Automatically Collected” information and “Cookies” information, alone or in combination with other information we have collected from you, to: (a) personalize the Theology Together Service, such as remembering your information so that you will not have to re-enter it during your visit or the next time you access the Theology Together Service; (b) provide customized content and information; (c) monitor aggregate usage metrics; and (d) measure service and marketing performance where permitted by law and subject to applicable consent.

Theology Together may use your email address or other personally identifiable information to send (a) messages about the Theology Together Service, such as account, purchase, course, security, or support communications, and (b) promotional messages related to the Theology Together Service and the activities of third parties we work with. Generally, you have the ability to unsubscribe from further promotional communications through links provided in the messages.

3. WHEN WE DISCLOSE INFORMATION

Theology Together does not share your personally identifiable information with other organizations for their marketing or promotional uses without your prior consent. We may disclose User information to affiliated companies or other businesses or persons who: provide web site hosting, maintenance, and security services; fulfill orders; conduct data analysis and create reports; offer certain functionality; and assist Theology Together in improving the Theology Together Service and creating new features. These disclosures are generally made under terms comparable to this Privacy Policy, and recipients are limited to using the information for the purposes for which it was provided and only to the extent necessary to complete the intended work. Theology Together does not sell personal information for monetary consideration. If a disclosure is treated as a “sale” or “sharing” under applicable privacy law, you may opt out as described below.

The Service is designed for adult account holders to access educational video content and related auto-graded quizzes; children may view educational videos and take auto-graded quizzes through a parent or guardian’s account, but do not create accounts, communicate directly with Theology Together, or interact with other users. Educational content made available through the Theology Together Service remains subject to the Terms of Service and may not be used, reproduced, or reposted without prior written permission from Theology Together or the applicable rights holder, as applicable.

Theology Together may disclose your information if required to do so by law or in the good-faith belief that such action is necessary to comply with state and federal laws (such as U.S. Copyright law) or respond to a court order, judicial or other government subpoena, or warrant in the manner required by the requesting entity. Theology Together also reserves the right to disclose User information that we believe, in good faith, is appropriate or necessary: to take precautions against liability; to protect Theology Together from fraudulent, abusive, or unlawful uses; to investigate and defend ourselves against third-party claims or allegations; to assist government enforcement agencies; to protect the security or integrity of the Theology Together Service; or to protect the rights, property, or personal safety of Theology Together, our Users, or others.

4. YOUR CHOICES

You may, of course, decline to share your personally identifiable information with Theology Together, in which case Theology Together may not be able to provide to you some of the features and functionality found on the Theology Together Service. You may update or correct your account information and preferences at any time by accessing your account preferences page through the Theology Together Service. Please note that while changes to your account are reflected promptly in active user databases, we may retain all information that we collect or that you provide for a variety of purposes, including backups and archiving, prevention of fraud and abuse, and analytics. To protect your privacy and security, we take reasonable steps to verify your identity before granting you account access or making corrections to your information.

YOU ARE RESPONSIBLE FOR MAINTAINING THE SECRECY OF YOUR UNIQUE PASSWORD AND ACCOUNT INFORMATION AT ALL TIMES.

5. OUR COMMITMENT TO DATA SECURITY

Theology Together uses certain physical, managerial, and technical safeguards designed to preserve the integrity and security of your personal information. We cannot, however, ensure or warrant the security of any information you transmit to Theology Together, and you do so at your own risk. Theology Together cannot guarantee that information you provide or that we collect may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. If Theology Together learns of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps. Theology Together may post a notice on the Theology Together Service if a security breach occurs. Depending on where you live, you may have a legal right to receive notice of a security breach in writing. To receive a free written notice of a security breach you should notify us. Because the Theology Together Service is hosted on the Kajabi platform, certain technical and infrastructure security measures, including server-level security and data storage, are managed by Kajabi. Theology Together relies on Kajabi’s security infrastructure and does not independently control all aspects of data storage and protection. For information about Kajabi’s security practices, please refer to Kajabi’s privacy and security documentation.

Colorado Data Breach Notification. If Theology Together determines that a security breach involves the personal information of a Colorado resident, Theology Together will provide notice in compliance with C.R.S. § 6-1-716. Notification will be provided to affected Colorado residents within 30 days after determining that a security breach occurred and, when required by law, to the Colorado Attorney General. Covered information includes a first name or first initial and last name in combination with a Social Security number, driver’s license or identification-card number, an account number or credit or debit card number with a security code, biometric data, or other categories specified by Colorado law.

6. OUR COMMITMENT TO CHILDREN'S PRIVACY

Adult account holders; COPPA and state children’s privacy laws. The Theology Together Service is an educational platform designed for parents and guardians to use with their children. All accounts are created and owned by adult account holders (parents or legal guardians). Children are not the intended account holders and are not permitted to create their own accounts. Because accounts are owned by parents and guardians, and because Theology Together does not direct children to create accounts or knowingly collect personal information directly from children under 13, our platform operates as a general-audience service with parental controls rather than a child-directed service. Theology Together does not require children to submit personal information to view educational content through a parent’s account. Under the Colorado Privacy Act (C.R.S. § 6-1-1301 et seq.), personal data from a known child is sensitive data. Theology Together will obtain consent before processing sensitive data, including children’s data, to the extent required by the CPA, and will not process children’s data for targeted advertising.

Profile information. Although the Theology Together Service is designed for adult account holders, we recognize that a child using a parent or guardian’s account could potentially modify account profile information (such as uploading a profile photo or changing the display name). Such modifications do not change the account holder’s identity or create a separate child account. If Theology Together becomes aware that a child under 13 has submitted personal information through an account, we will take steps to remove that information and may contact the account holder.

Adult account holder consent. Because Theology Together does not knowingly collect personal information directly from children, our consent framework is based on the adult account holder’s agreement to the Terms of Service and this Privacy Policy at the time of account creation and purchase. The adult account holder’s acceptance of these terms constitutes acknowledgment and consent for any minor’s use of educational content through the adult’s account.

Information collected and used. Theology Together collects information from the adult account holder, such as email address and payment information, in connection with account creation and purchases. We do not collect personal information directly from children. If a child accesses educational content through a parent or guardian’s account, any interaction data (such as quiz responses or video viewing activity) is associated with the adult’s account, not a separate child profile.

No unnecessary condition. Theology Together does not require a child to submit personal information as a condition of accessing educational content through a parent or guardian’s account.

Parent and guardian choices. Because the adult account holder owns and controls the account, the account holder may at any time access and review all account information, update or correct account information, delete the account, or contact us with any privacy concerns at [email protected].

Retention of account information. Account information is retained for as long as the account is active and for a reasonable period thereafter, consistent with the Data Retention section of this Privacy Policy and applicable law.

Users under 18. The Theology Together Service is not intended for use by unaccompanied minors. All users under 18 should access the Service through and under the supervision of a parent or guardian’s account.

Educational institutions and FERPA. When the Theology Together Service is used by or on behalf of a formal educational institution, Theology Together will support the institution’s compliance with the Family Educational Rights and Privacy Act (FERPA) and applicable student-privacy laws. This applies only to use by a formal educational institution and its authorized users; use by homeschool co-ops, churches, or informal groups does not, by itself, implicate FERPA. Our collection, use, and disclosure of education records will be governed by applicable law and the institution’s instructions and agreements with Theology Together.

Colorado student data. When the Theology Together Service is used by a Colorado public school, school district, or charter school, Theology Together will comply with the Colorado Student Data Transparency and Security Act, C.R.S. § 22-16-101 et seq. Theology Together will not use student personally identifiable information for targeted advertising directed at students based on their student data, sell student personally identifiable information, or use student data for purposes other than those authorized by the educational institution or required by law. Theology Together will maintain reasonable security procedures and practices for student data, delete student data upon request of the school or district within a reasonable timeframe, provide transparency about what student data is collected and how it is used, and enter into any data-sharing agreements required by Colorado law with educational institutions.

Unauthorized collection. If we learn that a child under 13 has created an account or submitted personal information without a parent or guardian’s involvement, we will promptly delete the account and associated information unless retention is required by law or necessary to protect safety.

7. INTERNATIONAL VISITORS

GDPR and UK GDPR. For users in the European Economic Area (EEA), the United Kingdom, or other jurisdictions with similar privacy laws, Theology Together processes personal information in accordance with applicable law, including the General Data Protection Regulation (GDPR) and the UK GDPR. Depending on the circumstances, our legal bases include performing a contract with you, complying with a legal obligation, obtaining your consent, and pursuing legitimate interests such as securing, maintaining, and improving the Theology Together Service. Where we rely on consent, you may withdraw it at any time without affecting prior processing.

Data subject rights. Subject to applicable law and exceptions, EEA and UK users may request access to their personal information; rectification of inaccurate or incomplete information; erasure; a portable copy of information provided to us; restriction of processing; and the right to object to processing based on legitimate interests or to direct marketing. You may also withdraw consent and lodge a complaint with your local data protection supervisory authority. To exercise these rights, contact [email protected]; we may request information needed to verify your identity.

International transfers. Information may be transferred to and processed in the United States or other countries outside the EEA or United Kingdom. When required, Theology Together uses lawful transfer mechanisms, including European Commission Standard Contractual Clauses, the UK International Data Transfer Addendum or other UK-approved safeguards, adequacy decisions, and other legally recognized protections. Where required, we will obtain consent or provide another lawful basis for the transfer.

8. CALIFORNIA PRIVACY RIGHTS (CCPA/CPRA)

California consumer rights. California residents may have rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA). Subject to applicable exceptions, a California resident may request to know or access the categories and specific pieces of personal information we collect, the sources, purposes, and recipients; request deletion; request correction of inaccurate information; opt out of the sale or sharing of personal information; limit the use and disclosure of sensitive personal information; and receive equal service and price without discrimination for exercising these rights.

To submit a California privacy request, contact [email protected] and identify the request you are making. We will verify your identity, respond within the time required by law, and permit an authorized agent to submit a request when legally permitted and properly authorized. Although Theology Together does not sell personal information for monetary consideration, you may opt out of any sale or sharing recognized under California law, including sharing for cross-context behavioral advertising, by contacting us or using a Global Privacy Control signal as described below.

Minors. Theology Together does not knowingly sell or share the personal information of a consumer under 16 without the opt-in consent required by law. The Service is not intended for minors to create or own accounts, and any use by a minor should occur through and under the supervision of an adult account holder.

9. COLORADO PRIVACY RIGHTS

Colorado residents. Theology Together LLC is a Colorado limited liability company. Colorado residents have specific rights under the Colorado Privacy Act (CPA), C.R.S. § 6-1-1301 et seq. Subject to applicable exceptions and verification requirements, these rights include: (a) the right to confirm whether their personal data is being processed and to access that data; (b) the right to correct inaccuracies in their personal data; (c) the right to delete personal data provided by or obtained about them; (d) the right to obtain a portable copy of their personal data in a readily usable format; and (e) the right to opt out of the processing of personal data for purposes of targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects concerning them.

Requests and response times. Consumers may exercise these rights by contacting [email protected]. Theology Together will respond to an authenticated request within 45 days. If reasonably necessary, Theology Together may extend the response period once by an additional 45 days after providing notice of the extension to the consumer. Theology Together will not discriminate against consumers for exercising their CPA rights.

Appeals. If Theology Together declines a request, the consumer may appeal by contacting Theology Together at [email protected]. Theology Together will respond to the appeal within 45 days. If the appeal is denied, the consumer may file a complaint with the Colorado Attorney General at coag.gov.

Sensitive data and targeted advertising. Under the CPA, children’s personal data is classified as sensitive data. Theology Together will obtain consent before processing sensitive data, including children’s data, to the extent required by the CPA. Theology Together does not sell personal data as defined by the CPA and does not process personal data for targeted advertising directed at children.

Data protection assessments. Theology Together will conduct data protection assessments for processing activities that present a heightened risk of harm, including processing children’s data and processing for targeted advertising, as required by the CPA.

Universal opt-out. Theology Together recognizes the Global Privacy Control (GPC) signal as a valid universal opt-out mechanism under the CPA and will treat it as a request to opt out of the sale of personal data and targeted advertising.

10. STATE PRIVACY RIGHTS

Comprehensive state privacy laws. Residents of states with comprehensive privacy laws, including Virginia (VCDPA), Connecticut (CTDPA), Utah (UCPA), Texas (TDPSA), Oregon (OCPA), and similar or successor laws, may have additional rights. Depending on the applicable law, these may include the rights to confirm processing and access personal information, correct it, delete it, obtain a portable copy, opt out of sale, targeted advertising, or certain profiling, and appeal a decision on a privacy request.

These rights are subject to applicable thresholds, exceptions, and verification requirements. To exercise a right or appeal a decision, contact [email protected] and state your residence and request. Theology Together will not discriminate against you for exercising rights granted by applicable law and will provide any additional disclosures or opt-in or opt-out mechanisms required by that law.

11. DO NOT TRACK / GLOBAL PRIVACY CONTROL

Browser privacy signals. Some browsers and devices transmit “Do Not Track” (DNT) signals. Because there is no uniform industry standard, the Theology Together Service may not respond to DNT signals. Where required by applicable law, we recognize the Global Privacy Control (GPC) signal as a request to opt out of the sale or sharing of personal information, including cross-context behavioral advertising, and apply the signal to the browser or device that sends it.

12. DATA RETENTION

General retention practices. Theology Together retains personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including providing and securing the Theology Together Service, administering accounts, supporting educational programs, communicating with users, complying with legal and contractual obligations, resolving disputes, and enforcing agreements. We determine retention periods based on the amount, nature, and sensitivity of the information; the purposes for which it is used; legal, regulatory, and contractual requirements; and security and operational needs. When information is no longer needed, we delete it, anonymize it, or securely isolate it. Information in backups may remain for a limited period until the backup is overwritten, after which it is deleted or anonymized.

13. IN THE EVENT OF MERGER OR SALE

In the event that Theology Together is acquired by or merged with a third-party entity, we reserve the right, in any of these circumstances, to transfer or assign the information that we have collected from Users as part of that merger, acquisition, sale, or other change of control.

14. CHANGES AND UPDATES TO THIS PRIVACY POLICY

This Privacy Policy may be revised from time to time and at any time and this will be reflected by an updated publication date at the top of this Privacy Policy. Please revisit this page to stay aware of any changes theologytogether.tv/privacy. In general, we only use your personal information in the manner described in the privacy policy in effect when we received that personal information. Your continued use of the Theology Together Service constitutes your agreement to this Privacy Policy and any future revisions.

Colorado Consumer Protection Act. Nothing in this Privacy Policy is intended to waive any rights consumers may have under the Colorado Consumer Protection Act, C.R.S. § 6-1-101 et seq., or any other applicable Colorado law.

15. CONTACT INFORMATION

Please contact Theology Together with any questions or comments about this Privacy Policy, your personal information, and our third-party disclosure practices or your consent choices at [email protected].
